Divorce lawyers: Facebook tops in online evidence

The Associated Press reports that Facebook and other social media sites are top evidence sources for divorce lawyers. You can read the entire article here.

The article reports that oversharing on social networks has led to an overabundance of evidence in divorce cases. The American Academy of Matrimonial Lawyers says 81 percent of its members have used or faced evidence plucked from Facebook, MySpace, Twitter and other social networking sites, including YouTube and LinkedIn, over the last five years.

Examples of the types of evidence that divorce lawyers have obtained from social networking sites include:

  1. Husband goes on Match.com and declares his single, childless status while seeking primary custody of said nonexistent children.

  2. Husband denies anger management issues but posts on Facebook in his "write something about yourself" section: "If you have the balls to get in my face, I'll kick your ass into submission."

  3. Father seeks custody of the kids, claiming (among other things) that his ex-wife never attends the events of their young ones. Subpoenaed evidence from the gaming site World of Warcraft tracks her there with her boyfriend at the precise time she was supposed to be out with the children. Mom loves Facebook's Farmville, too, at all the wrong times.

  4. Mom denies in court that she smokes marijuana but posts partying, pot-smoking photos of herself on Facebook.

If you or someone you know is going through a divorce, be honest and forthcoming with your divorce attorney about your social networking activities. Be sure to tell your lawyer your usernames for all the social sites you use, and even "friend" your attorney so he or she can review your posts. It will be better for your divorce case for your attorney to know what information is out there so the other side's arguments can be anticipated than it is to face the evidence for the first time in court.
