Roseville Divorce Attorney Discusses Attorneys Fees in Child Support Modification
Previous posts have discussed the 2007 case of Marriage of Feldman, which affirmed that spouses in a divorce owe each other broad fiduciary duties. The Court in Feldman upheld imposing sanctions and attorneys fees for the husband's failure to provide certain financial information to the wife.
Recently, the Second Court of Appeal in Marriage of Davis upheld the trial court's imposition of sanctions against the husband for his failure to provide all requested financial information in a child support custody modification case.
These recent cases make clear that the court's don't like it when a party tries to "hide the ball" in a family law case and not divulge critical financial information.
